The Art of persuading a judge or an arbitrator (1.5 hrs CPD)
Chaired by Sarah Wroe and presented by Hon. Raynor Asher QC and Hon. Paul Heath QC, this webinar will reflect on how counsel can best persuade judges and arbitrators that their client should succeed. The webinar will consider the differences in techniques for the different forums, including:
- Differences between written and oral advocacy
- Using opening submissions as a roadmap for effective advocacy
- Admissibility: differences between evidence and submission
- Closing your case effectively.

 | Hon Raynor Asher QC Raynor graduated BA LLB Hons in 1972 and obtained an LLM in the US where he studied as a Harkness Fellow. He was a partner in a firm, and in 1986 commenced practice as a barrister sole, being appointed Queens Counsel in 1992. During his time at the Bar, he had a wide-ranging commercial practice and appeared on numerous occasions in all the New Zealand trial and appellate Courts including frequent appearances in the Privy Council, as well as defending and prosecuting in the criminal arena. From 1996 – 1998 he was President of the New Zealand Bar Association | Ngā Ahorangi Motuhake o te Ture. He was President of the Auckland District Law Society between 2002 and 2003 and Vice-President of the New Zealand Law Society from 2003 – 2005. He was President of the Legal Research Foundation and is an Honorary Fellow. He was appointed to the High Court Bench in 2005 and to the Court of Appeal in 2016. He retired from the Bench in March 2019 and joined Richmond Chambers in Auckland. | |
 | Hon Paul Heath QC Hon Paul Heath QC was admitted to the Bar in 1978. After practising in a firm, in 1998 he joined the separate Bar and was appointed as a Queen’s Counsel. Paul served as a High Court Judge between 2002 and 2018. During that time, he presided over a number of significant criminal jury trials, as well as Judge-alone fraud trials. From 2003, until 2016, Paul sat as a member of both the Criminal and Civil Appeal Divisions of the Court of Appeal on a regular basis.  | Sarah Wroe (Chair) Sarah is a barrister at Eldon Chambers, Auckland, and a member of the Bar Association’s Education committee. She graduated First Class in law from Cambridge University and was called to the Bar of England & Wales in 1998. She practised as a civil and criminal barrister in England for 7 years. She was admitted to the Bar here in 2011 and joined the independent Bar in 2017. Sarah has a general common law practice with a particular focus on matters touching on property law. She is an adjunct instructor for the College of Law Professional Legal Studies Course in property, civil litigation, and advocacy. |

If you cannot find a substitute or attend the live webinar yourself, a recording together with CPD material can be made available to you shortly afterwards. A refund less a service fee of $25.00 will apply to all cancellations (received in writing) before midday Monday 3 August 2021. There will be no refunds for cancellations received after that time. The NZBA reserves the right to cancel or reschedule seminars if necessary.
