The Trusts Act 2019 came into effect on 31 January 2021.  How is this playing out in practice?  

Join us as Lady Deborah Chambers KC and Vanessa Bruton KC discuss their personal litigation / resolution experience under the new regime, and provide their tips on your litigation / resolution approach, whether acting for a trustee or beneficiary.  Carole Smith from Fortyeight Shortland Barristers will chair the presentation.

Lady Deborah Chambers KC

Lady Deborah Chambers KC is one of the leading trust litigation and relationship property lawyers in New Zealand. She specialises in equity litigation, including fiduciary relationships and obligations.

Her background is as a prosecutor in both general civil litigation and criminal law, but since 1996 she has specialised in relationship property law, trusts, estates and fiduciary duties. Her work in this area includes complex cases frequently involving international property.

Lady Deborah was admitted to the bar in 1983 and commenced practice as a barrister sole in 1989. She was made QC in 2007. Her litigation experience includes frequent appearances in the Family Court, High Court, Court of Appeal and the Supreme Court. Lady Deborah is also experienced at representing clients in mediations.

In March 2022 she was listed as the leading family and relationship property law Senior Counsel in Doyles Guide.

 

Vanessa Bruton KC

Vanessa is a litigator, practising almost exclusively in trust and estate disputes, including where relationship property is involved. She has been counsel in a number of the leading cases over recent years.  She went to the independent bar in 2014 and took silk in 2016.  For more about Vanessa see www.trust-litigation.co.nz

 

Carole Smith  

Carole is a barrister based at FortyEight Shortland Barristers in Auckland. She has an extensive trusts background and specialises in disputes concerning estates, trusts and claims in equity.
