Requirements

The Lawyers and Conveyancers Act (Lawyers: Ongoing Legal Education - Continuing Professional Development) Rules 2013 (CPD Rules) require lawyers who provide regulated services to complete 10 CPD hours each year. The CPD year runs from April to March.

Lawyers who hold practising certificates but do not provide regulated services are not required to complete any hours of CPD activities, but will still need to prepare a continuing professional development plan and record (CPDPR) and to file declarations to that effect.

All lawyers must:

  • Develop a CPDPR for the year;
  • Complete the minimum 10 hours (if they provide regulated services);
  • Submit a declaration to the Law Society to the effect that they have completed their CPDPR and that they have completed the minimum CPD hours (or that they do not provide regulated services).

What activities count to CPD?

The CPD activities undertaken must be within the bounds of the CPDPR developed by the practitioner. They also must be: 

  • Verifiable (this could be as simple as a receipt for a seminar or a copy of an article which has been written);
  • Provide opportunity for interaction/feedback;
  • Be planned and structured, having stated purposes and outcomes;
  • Be related to identified learning requirements;
  • Not be part of a practitioner's day to day work.

They may include:

  • Attending courses, seminars, webinars , conferences, training, coaching and study groups
  • Interactive distance learning programmes and on demand (recorded) webinars;
  • Lecturing, teaching or instructing (including reasonable preparation time);
  • Writing legal articles/books;
  • Preparing and presenting submissions (e.g. on law reform issues - there are requirements as to the kind).

There are a number of limitations on what can and cannot be included within the above. Of note is the requirement that there be an element of feedback or interactivity. This is relevant to recorded material. A recording without interactivity is not considered eligible.

The CPDPR

The CPDPR is not submitted with the CPD declaration, but it may be required for audit purposes or if a practitioner applies for a deferment. The CPDPR is an ongoing record with no start/stop date. It has to include:

  • Learning needs;
  • An action plan to achieve these;
  • An activities record;
  • Reflections on outcomes;
  • Reflections on future learning needs;
  • documentation verifying attendance.

The Law Society's Guidelines suggest dividing the CPDPR into the following learning needs:

  • ethics, professionalism and client care;
  • knowledge of the law;
  • legal skills;
  • personal management skills;
  • practice management skills;
  • law and procedures in other countries;
  • other relevant disciplines.

CPDPR Format options

There is no prescribed format for a CPDPR. It depends on what is needed by the practitioner. However there are various methods of keeping your CPDPR up-to-date such as online record keeping, using spreadsheets or just sticking to a simple Word document. 

Online options include:

  • The NZBA has a module for members to record CPD activities that they have undertaken, including non-NZBA events (please note that this is not a full CPDPR but only tracks training history);
  • Storkk.co.nz is an independent service which allows a practitioner to see what events are offered by various suppliers, and to keep a record of these activities. This service is free;
  • The Law Society's continuing legal education arm NZLS CLE Limited has its own online CPDPR system;
  • ADLS Inc also has its own online CPDPR module.

If you are not comfortable with online, then you can use the Law Society's templates available on the website. Although the rules do not specify any particular format, the templates provide guidance and reassurance you are on the right track.

Auditing for compliance and failure to comply

Each year the Law Society will examine a sample of lawyers' CPDPRs and documentation to verify they have met the requirements. If a lawyer appears to have misunderstood the CPD Rules, assistance and education will be offered by way of correction. 

However a knowingly false declaration of compliance will be referred to a standards committee for inquiry under the Lawyers and Conveyancers 2006. The CPDPR may be required by the standards committee for consideration at this stage.
