Presented by Damian Chesterman and Royden Hindle, this 1.5 hour webinar demonstrates a practical approach to arbitration. Topics to be considered include:

  • Overview of Arbitration and application of Arbitration Act 1996 
  • Hybrid processes – arbitration is combined with a mediation process 
  • Challenges to jurisdiction and challenges to arbitrators
  • Preliminary orders, interim measures, emergency arbitrators
  • Confidentiality/privacy when an award is appealed to the High Court 
  • Natural Justice – including the ability to limit the scope of natural justice 

The presenters will also consider significant Supreme Court decisions and recent legislative developments, including draft Bill clauses relating to arbitration of trust disputes. 

Our Presenters:

 Damian Chesterman is a commercial and civil barrister who has over 20 years of trial experience. He is an Associate member of the Arbitrators’ and Mediators’ Institute of New Zealand (AMINZ) and is currently completing the fellowship accreditation programme. He studied international arbitration at Cambridge University, England, and for over four years he practised in New York and London as a Senior Associate with a prominent New York product liability firm assisting in multi-billion dollar international litigation and arbitration.

Damian is experienced in complex litigation and advisory work involving companies, trusts and individuals. His cases encompass directors’ and trustees’ duties, shareholder and beneficiary actions, equitable duties and remedies, contract and tort claims, the Fair Trading Act, misrepresentation and fraud. He is experienced in lease and land disputes and advises on defamation issues.
   
 

Royden Hindle practises as an arbitrator, commercial mediator, construction adjudicator, facilitator and (occasionally) as an advocate.  With over 35 years’ practice variously as a civil litigation partner at Simpson Grierson, barrister, Tribunal Chair, mediator, arbitrator, amicus curiae, adjudicator and teacher, he is able to draw on a long and varied experience in dealing with disputes from all perspectives. Royden moved to the independent bar in 1996.  
Royden is a:

  • Member of both the Mediation and Arbitration Panels of the Arbitrators’ and Mediators’ Institute of New Zealand (‘AMINZ’)
  • AMINZ Council member since 2012 and is presently serving as President-Elect
  • AMINZ Director of Professional Studies
  • Principal Arbitrator, Evaluator & Mediator at the New Zealand Disputes Resolution Centre and Building Disputes Tribunal
  • Resolution Institute-accredited mediator
  • Teacher (post-graduate and under-graduate levels) in Dispute Resolution at AUT Law School

Cancellation-Refund Policy: If a participant is unable to attend the seminar, a substitute participant is welcome to attend at no additional cost. If you cannot find a substitute or attend the live webinar yourself,  a recording together with CPD material can be made available to you shortly afterwards. A refund less a service fee of $25.00 will apply to all cancellations (received in writing) before midday Monday 24 September 2018. There will be no refunds for cancellations received after that time. The NZBA reserves the right to cancel or reschedule seminars if necessary.
